Pixmind provides an AI-powered image prompt generation platform that allows users to create and enhance prompts for AI image generation. Our service includes:

  • Magic enhance functionality for prompt refinement
  • API integration for programmatic access
  • Credit-based usage tracking and management

3. User Accounts

To use our services, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

  • You must provide accurate, current, and complete information
  • You must keep your login credentials secure and confidential
  • You are responsible for all activities under your account

4. API Usage and Limitations

Your use of Pixmind's API services is subject to the following terms:

  • Prices may be updated with 30 days advance notice

7. Intellectual Property

Pixmind and its services are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our services without our express written permission.

  • The AI prompt generation technology and models remain our proprietary property
  • You retain ownership of your input images, text, and generated prompts for legitimate use
  • You grant us a license to process your content for service provision

7A. Outputs and Commercial Use

Use of outputs depends on the account plan in effect when the output is created:

  • Outputs created with a free account are licensed for personal, non-commercial use only.
  • While a paid membership is active, PixMind grants the account holder a worldwide, non-exclusive, royalty-free license to use eligible outputs commercially, including in advertising, marketing, websites, social media, print, film, products, and client work.
  • Eligible outputs created during an active paid membership remain commercially licensed after that membership expires. Creating new commercially licensed outputs requires an active paid membership.
  • The account license and certificate are non-transferable, but eligible finished work may be delivered to clients.
  • This license does not grant rights in inputs, uploads, reference materials, trademarks, logos, characters, music, likenesses, or other third-party content. You are responsible for obtaining any required rights and permissions.

8. Prohibited Uses

You agree not to use Pixmind's services for:

  • Illegal activities or violation of any laws
  • Creating misleading or deceptive content without proper disclosure
  • Harassment, abuse, or harm to others
  • Spam, phishing, or fraudulent activities
  • Generating harmful, offensive, or inappropriate prompts
  • Attempting to gain unauthorized access to our systems
  • Interfering with or disrupting our services
  • Violating intellectual property rights of others

Reporting

When to Report

  • Content or behavior that violates the content standards of this Policy (Section 8).
  • Critical violations involving child safety or terrorism.
  • AI impersonation or infringement of your own rights.
  • Any other situation the Platform deems reportable.

Reporting Principles

  • Confidentiality: reporter identity is strictly protected.
  • Impartiality: all reports receive independent, objective review.
  • Anti-abuse: malicious or false reports are recorded and actioned.

To submit a report, email [email protected] with the content link or description, relevant screenshots, and a brief explanation. We aim to acknowledge valid reports within 3 business days and take appropriate action — which may include removing the content, suspending or terminating the responsible account, and, where required by law, notifying the relevant authorities.

9. Service Availability

While we strive to provide reliable service, we do not guarantee 100% uptime. We may perform maintenance, updates, or experience outages that temporarily affect service availability. We will provide reasonable notice for planned maintenance when possible.

10. Disclaimer of Warranties

Pixmind's services are provided "AS IS" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Pixmind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

12. Termination

Either party may terminate this agreement at any time. Upon termination, your access to Pixmind's services will cease, and any remaining credits may be forfeited. We may terminate or suspend your account for violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pixmind operates, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through our service. Continued use of our services after changes constitutes acceptance of the new Terms.
